Commercial leases: monthly rent payments and capped security deposits

Traditionally, commercial rents are paid quarterly, which places a considerable burden on retailers’ cash flow, especially when they are starting out. In addition, security deposits can amount to as much as twelve months’ rent, a sum that ties up valuable funds.

Announced as part of the simplification bill, the reform proposes two significant changes:

  • Monthly rent payments, enabling retailers to manage their cash flow better by spreading payment over the year.
  • A cap on security deposits at three months’ rent, reducing the financial barrier for new entrants and easing the burden on existing retailers.

These adjustments also represent both a challenge and an opportunity for landlords: the move to monthly invoicing will require administrative adjustments, but could lead to more stable and predictable relationships with tenants.

According to the ministry, implementing this reform could free up to €2 billion in cash for retailers across France, with positive repercussions on investment and consumption.

This reform is a step towards simplifying commercial relationships and reducing the administrative burden on retailers. Its effects on rental values and lease negotiations deserve to be followed closely.
